Marijuana Remains Illegal In Idaho

Various states have obtained legality of various forms of marijuana even as the debate for legalization ranges on in others. For example, having recreational marijuana in Oregon and Washington is legal while Montana and Nevada have the legality of medical marijuana. On the other hand treatment of seizures using Cannabidiol is not a crime in Wyoming and legislation to decriminalize pot possession is underway.

However, the story is not the same in Idaho because whether it is for sickness or real-time purposes, marijuana is illegal. In fact, being charged with possession of up to an ounce of marijuana leads to a one-year jail term of up to $1,000 fine. Possession of more than three ounces is considered a felony that calls for up to five years in prison, a fine of up to $10,000 and in the very extreme case both can be applied.

Cannabidiol contains little THC, which is the psychoactive component in marijuana. It is commonly used in people suffering from seizures but must be prescribed by a physician. A bill to make legal Cannabidiol was approved last year by the Idaho Legislature, but it was banned by Gov. C.L. “Butch” Otter. In its replacement, an executive order was issued that would allow 25 children suffering from epilepsy partake in an experimental program of cannabis oil treatments.

But it seems like Gov. Otter’s actions have not been taken kindly. Idaho Sen. Roy Lacey, D-Pocatello argues that with an overwhelming passing of the bill in the House and Senate last year, and having discovered something that can treat the children with epilepsy, there is no real reason as to why it should not be approved.

Well, it’s a matter of changing the leadership’s thinking according to Lacey if Idaho is to consider medical marijuana in the future.

However, Idaho State Police feels otherwise about the legalization of marijuana and explicitly states that future generations of Idahoans must be protected. In fact, someone like Republican Sen. Jim Guthrie, R-McCammon says that there is no conviction as to why medical marijuana should be legalized.

And as the debate about marijuana legalization heats up, chances of its use or decriminalization are still very low minimal since there are no bills in the Idaho Legislature being discussed regarding Idaho Legislature.
